ATV ESCAPE TERMS OF USE

These "Terms of Use" set forth the terms and conditions that apply to your use of www.atvescape.com (the "The Site"). By using The Site (other than to read this page for the first time), you agree to comply with all of the Terms of Use set forth herein. The right to use The Site is personal to you and is not transferable to any other person or entity.

Copyrights and Trademarks

1. All material on this site, including, but not limited to images, articles, illustrations, audio clips, and video clips, are protected by copyrights which are owned and controlled by ATV Escape or by other parties that have licensed their material to ATV Escape. All material on this site is Copyright November 12, 2007, ATV Escape. All rights reserved.
2. No person is authorized to use, copy, or distribute any portion of The Site. Unless granted written permission by ATV Escape, material from www.atvescape.com may not be used for non-personal or commercial purposes and may not be copied, reproduced, republished, uploaded, downloaded, posted, framed, transmitted, sold in whole or in part, or distributed in any way. Modification of the materials including, but not limited to, removal of copyright, trademark or other notice of proprietary rights, or use of the materials for any other purpose is a violation of this Terms of Use Agreement, as well as laws protecting copyrights and other proprietary rights. For purposes of this Terms of Use Agreement, unless granted permission by ATV Escape, the use of any such material on any other computer-related environment is prohibited. Provided that you are eligible for use of The Site, you are granted a limited license to access and use The Site and The Site Content and to download or print a copy of any portion of The Site Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright or other proprietary notices intact. Such license is subject to these Terms of Use and does not include use of any data mining, robots or similar data gathering or extraction methods.
3. ATV Escape and other trademarks and/or service marks (including logos and designs) found on The Site are trademarks/service marks that identify ATV Escape and the goods and/or services provided by ATV Escape. Such marks may not be used under any circumstances without the prior written authorization of ATV Escape.

Eligibility

Membership in the Service is void where prohibited. ATVEscape.com is intended solely for users who are thirteen (13) years of age or older. Any registration by, use of or access to this Site by anyone under 13, is unauthorized, unlicensed and in violation of these Terms of Use. By using the Service or The Site, you represent and warrant that you are 13 or older and that you agree to and to abide by all of the terms and conditions of this Agreement. We encourage all users less than eighteen (18)  years of age to get permission from their parent or parents before joining  ATV Escape or submitting any personally identifying information.  We also encourage parents to monitor their  children’s activity on our site.

User Submissions

Any communication or other material submitted or posted to The Site will be considered non-confidential and by posting or otherwise submitting any communication or other material you automatically grant, and you represent and warrant that you have the right to grantATV Escape a royalty-free, perpetual, irrevocable, nonexclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform, and display the communication or material alone or as a part of other works in any form media, or technology whether now known or hereafter developed, and to sublicense such rights through multiple tiers of sublicenses.

User Conduct Policy

Under the Terms of Use you must not:

• Post any sexually explicit or depicts graphic or gratuitous violence image, video, message, content, or  link to such material; 

• Impersonate another person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity;

• Post any content which contains obscene, threatening, harassing,libelous, defamatory, rude, malicious, hateful, or otherwise inappropriate language;  

• Post any content which infringes on or violates any intellectual property rights belonging to any other entity or person, including, but not limited to violation of copyrights, trademarks, laws governing trade secrets, rights to privacy, or publicity;

• Post any content, which violates any international, national, state, or local law or encourages illegal activity of any kind; Advertise or otherwise solicit funds, post any content, which is a solicitation for goods, services or participation in any pyramid schemes, or post any chain letters;

• Use any of the submitted content for any commercial gain;

• Send or make available any unsolicited or unauthorized advertising, solicitations, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation using ATV Escape's systems;

• Register for more than one account or use or attempt to use another's account, service or system without authorization or create a false identity on the ATV Escape site;

• Solicit passwords or personal information from anyone, including those under 18;

• Engage in any predatory or stalking conduct;

ATV Escape reserves the right to remove any material at its sole discretion that violates the above conditions, or is otherwise inappropriate.

Reporting Violations of Terms of Use and User Conduct Policy

Termination of Use

ATV Escape reserves the right to terminate this user agreement, at its sole discretion, and ban any user who violates any of the above terms of use.  ATVEscape.com may terminate your membership, delete your profile and any content or information you have posted on The Site and prohibit you from using or accessing The Site, for any reason, or no reason, at any time in its sole discretion, with or without notice, including without limitation if it believes that you are under 13 or believes you have violated the User Conduct or these Terms of Use.

Links to Third-Party Web Sites

ATV Escape may provide hyperlinks to third-party The Sites as a convenience to users of The Site. ATV Escape does not control third-party The Sites and is not responsible for the contents of any linked-to, third-party The Sites or any hyperlink in a linked-to The Site. ATV Escape does not endorse, recommend or approve any third-party web sites hyperlinked from The Site. ATV Escape will have no liability to any entity for the content or use of the content available through such hyperlink. When using links from our site you are doing so at your own risk.

No Representations or Warranties; Limitations on Liability

The information and materials on The Site could include technical or mechanical inaccuracies or typographical errors. Changes are periodically made to the information contained herein. Indemnity

You agree to indemnify and hold the ATV Escape, its subsidiaries and affiliates, and each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorney's fees, arising out of or in connection with any User Content, any content you post or share on or through The Site, your use of The Site, your conduct in connection with The Site or with other users of The Site, or any violation of this Agreement or of any law or the rights of any third party. ATV Escape is not responsible for any content posted in our community, our forums, reviews, article comments, or any other user submitted content. ATV Escape does not represent or guarantee the truthfulness, accuracy, and reliability of any communications or content posted by its users. You acknowledge that any reliance on material posted by other users will be at your own risk. ATV Escape might not screen communications in advance and is not responsible for screening or monitoring material posted by users.

Changes to These Terms of Use

ATV Escape reserves the right to change these Terms of Use at any time by posting new Terms of Use at this location.
